In geschil is of LeaseWeb in augustus 2015 Hostslim heeft gewaarschuwd dat onderhoud zou plaatsvinden.
LeaseWeb heeft, ter onderbouwing van haar standpunt dat zij Hostslim per e-mail en door een melding in het klantenportaal heeft gewaarschuwd, de onder 4.6 genoemde e-mails in het geding gebracht (productie 5 bij inleidende dagvaarding).
Het eerste e-mailbericht, volgens LeaseWeb verzonden op 14 augustus 2015, luidt:
“(…) As part of our commitment to continually improve the level of service LeaseWeb
provides, you are receiving the following announcement to inform you about the upcoming datacenter maintenance (…).
WHAT CAN I EXPECT?
Between August 24th and August 27th 2015, Evoswitch and the utility vendors will be performing an electrical power distribution maintenance (…). This maintenance will not lead to interruptions of your Colocation services. During this maintenance 1 power feed will be disabled, resulting in a reduced level of redundancy for a period of maximum 5 hours.
WHY ARE YOU PERFORMING THIS MAINTENANCE?
We are committed to provide our customers with the best service they expect. To support our continuous growth and guarantee to improve our service levels, modifications to the electrical power distribution (…) are required. This activity is fully scripted and may include the use of equipment system vendors and service providers.
WHEN WILL THE MAINTENANCE TAKE PLACE?
August 24th and 25th: Modifications will take place in the power distribution of (…) mainboard 9
August 26th and 27th: Modifications will take place in the power distribution of (…) mainboard 10
Maintenance window | 07.00-12.00hrs CEST
Important: We do strongly advise to check if your equipment is properly connected to both the A- and the B-feed, before we will start the maintenance.

Het tweede e-mailbericht, volgens LeaseWeb verzonden op 19 augustus 2015, luidt:
“(…) Last Friday we informed you that EvoSwitch and the utility vendors will perform
scheduled maintenance (…), where we strongly advised you to check if your equipment is properly connected both the A and B feed.
During an extra control round from our LeaseWeb engineers, to ensure this maintenance does not impact your operations, we found out that your equipment is not properly connected to the A and/or B feed. As a result of this, the scheduled maintenance will have impact on your current colocation setup.
We advise you to take appropriate actions or accept the downtime. (…)
