Bij e-mail van 7 september 2017 heeft werknemer [betrokkene 1] bericht – voor zover van belang -:
“(…) Regarding the Open recourcing system it seems that jobs were available and new ones will become available in the (near) future. It is mainly a matter of indentifying them.
The Compagny has the right to change its terms at any moment. This is undisputed. Likewise, I preserve the same rights to change (including making additions) my comments to the agreement at any moment as well.
You make the comment that the agreement document can only be provided after the choice form is provided by the employee. You have provided this comment several times before. Logically, that means the the terms and conditions are different for each of the options chosen. Please provide an overview of the difefrence of the terms and conditions for each of the options on the choice form.
Please find my comments on the agreement below. For clarity, they are subject to the aforementioned right to change in a similar way as the Compagny had done:
1.Please add a “Begrippenlijst/definities” at the start of the agreement. The current paragraph 8 is confusing.
2.Please add the “Arbeidsovereenkomst” as an appendix to the agreement as reference.
3.Paragraph 1.5 provides “..de verwijzing in de Arbeidsovereenkomst naar het verbod om werknemers te benaderen van Werkgever of een andere onderneming die behoort tot of gelieerd is aan de Royal Dutch Shell Groep met het doel om deze werknemers ertoe te bewegen hun arbeidsovereenkomst op te zeggen dan wel die relatie te beschadigen. This should be limited to items which are covered by the confidentiality agreement/clauses. Now it is generic and hence is a limitation to the freedom of speech.
4.Paragraph 2.3 refers to the LTIA TCA. Please add this agreement as signed by myself as an appendix for reference.
5.Paragraph 4.2 provides: “Partijen zullen zich onthouden van negatieve uitlatingen over elkaar.”Though the intention is good, the current formulation is a limitation of the freedom of speech.
6.Paragraph 8.9 (i) is unclear. Please replace with “Werknemer per of voor de Einddatum een nieuwe functie binnen de organisatie van de Werkgever aangeboden krijgt en ten gevolge daarvan beide partijen overeenkomen om deze overeenkomst te beëindigen”
