Vonnis 17 februari 2012 (productie 7 van [eiser sub 1 t/m 3] ): de Amerikaanse rechter heeft [verweerder sub 1] in deze uitspraak veroordeeld wegens ‘contempt of court’. In de aanhef van deze uitspraak staat onder meer: “Notice having been given to respondent [verweerder sub 1] (Warren S. Robins, Esq., Hartman& Winnicki, appearing)”. In het dictum van het vonnis is het volgende bepaald:
“(1) ORDERED that Mr. [verweerder sub 1] be and hereby is Adjudged Guilty of Willful Contempt of Court for failing to obey and comply with, and for continuing to fail to obey and comply with this Court's Order dated November 7 2011, which ordered, inter alia, that all proceeds from the sale of the [bedrijfsnaam 1 (B.V.)] coffee stock then held at the Sloat Brothers Annex Warehouse in California shall be deposited into the Fisher & Phillips LLP Attorney Trust Account of this Court's appointed Special Master Cynthia Jacobs , Esq.; and it is
(2) FURTHER ORDERED that Mr. [verweerder sub 1] be and herby is Adjudged Guilty of Willful Contempt of Court for failing to obey and comply with, and for continuing to fail to obey and comply with this Court's Order this Court's ORDER TO WIRE TRANSFER FUNDS dated January 20, 2012 which ordered Mr. [verweerder sub 1] to wire-transfer no later than 9:00 am Amsterdam time (i.e., 3:00 am Eastern Time) on January 23, 2012, the sum of $1,423,883.08 to the Fisher & Phillips LLP Attorney Trust Account of this Court's appointed Special Master Cynthia Jacob, Esq.; and it is
(3) FURTHER ORDERED that Mr. [verweerder sub 1] shall be imprisoned until such date as he complies with this Court's Orders dated January 20, 2012 and November 7, 2011, by wire-transferring the sum of $1,4.23,883.08 to the Fisher & Phillips LLP Attorney Trust Account of this Court's appointed Special Master Cynthia Jacob. Esq.; and it is
(4) FURTHER ORDERED that a WARRANT FOR THE ARREST OF MR. [verweerder sub 1] be and hereby is issued, for the purpose of ordering the arrest of Mr. [verweerder sub 1] to brought before this Court for purposes of being imprisoned under paragraph 3 of this Order until such as he complies with this Court's Orders dated January 20, 2012 and November 7, 2011, as set forth above; and it is
(5) FURTHER ORDERED that until such time as Mr. [verweerder sub 1] complies with the Orders of this court and wire-transfers the $1,423,883.08 in funds to the Fisher & Phillips LLP Attorney Trust Account of this Court's appointed Special Master Cynthia Jacob, Esq., (a) Mr. [verweerder sub 1] shall remain imprisoned and (b) Mr. [verweerder sub 1] shall be assessed Sanctions of $7,500.00 per day effective as of February 17, 2012 to be paid within five (5) business days of the entry of this Order, and on a recurring basis to be paid each five (5) days thereafter while those Sanctions continue to run, to the Attorney Trust LLC, to be held on behalf of the Defendant-Counterclaimants, Third-Party-Plaintiffs, and Intervenors, until by Consent Order or further Order of this Court said parties agree to the division and application of same; and it is
(6) FURTHER ORDERED that if the Sanctions assessed in the preceding paragraph are not paid when due, then counsel for the Defendant-Counterclaimants, Third-Party-Plaintiffs, and intervenors may submit on notice a form of Judgment for said sanctions, to be entered by this Court against Mr. [verweerder sub 1] ; and it is
(7) FURTHER ORDERED that Punitive Damages be and hereby are assessed against Mr. [verweerder sub 1] in an amount to be determined by this Court upon separate application to be made within ten (10) business days of the entry of this order by Maciag Law, LLC, to be held on behalf of the Defendant-Counterclaimants, Third-Party-Plaintiffs, and Intervenors; and it is
(8) FURTHER ORDERED that if the $7,500 per day sanctions assessed in the preceding paragraph are not paid within five (5) business days of the entry of the Order, then counsel for the Defendant-Counterclaimants, Third-Party-Plaintiffs, and Intervenors may submit on notice a form of Judgment for said sanctions to be entered by this Court against Mr. [verweerder sub 1] ; and it is
(9) FURTHER ORDERED that attorney fees and costs of court are hereby awarded to the Defendant-Counterclaimants, Third-Party-Plaintiffs, Intervenors, in such amount as) this Court shall determine upon, within ten (10) days of the entry of this order, Thaddeus R. Maciag Esq., Maciag Law, LLC, attorney for Defendant-Counterclaimants, Third-Party-Plaintiffs, and Intervenors, submitting a Certification of Attorney Fees and Costs for all fees and costs incurred as a result of Mr. [verweerder sub 1] ’ contempt of court and defalcation as described in this Order; and it is
(10) FURTHER ORDERED that a complete record of this proceeding and the papers filed in connection with this Application shall be forwarded forthwith to the Office of the United States Attorney for the District of New Jersey and to the office of the Morris Country Prosecutor, for their review and appropriate disposition as to same; and it is
(11) FURTHER ORDERED that (a) Final Judgment in the amount of $1,423,388.08 is hereby entered against [verweerder sub 1] in favor of Cynthia Jacob Esq., as Special Master in Case #SSX-C-12-10.”
