Op 26 januari 2023 heeft [eiser] telefonisch contact opgenomen met NN om een autoverzekering voor de auto af te sluiten. Tijdens het telefoongesprek is het volgende besproken:

[eiser] : What security requirements?
NN: Eh, even kijken. The car must have an alarm system.
[eiser] : It’s alarm 1?
NN: No, let me check. Alarm class 3.
[eiser] : Oh no, it does not haven alarm 3.
NN: Ok, eh, are you going to put that alarm in the car?
[eiser] : I don’t thing so. No.
NN: Ok, because, eh, let me check. If you don’t do that eh, then you are not insured for eh, let me check, for diefstal, eh thefts, for stealing the car.
[eiser] : For what? For like, eh, thefts? Oh, eh, that’s ok, that is not a big problem. I hope it won’t [gelach].

NN: (…) And I told you about the alarm system.
[eiser] : Eh, ja, alarmsystem, in case it is stolen, then eh.. [gelach] I hope not. I hope not.
NN: Ja, let’s hope it will not happen, but I have said that.
[eiser] : the car has got quite some safety things, I can track my car even on the app, something like that.
NN: Oh ok. De aanvraag is gelukt. De car is insured from today.
[eiser] : Yeah, ok, from today. I just got the car.
